California Privacy Rights Notice
Effective January 1, 2023
This California Privacy Rights Notice (this “Notice”) supplements the information contained in our general Privacy Policy and applies solely to California residents (“you”). Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively “CCPA”), California residents have the right to make the following requests with respect to their personal information. (The terms “consumer,” “personal information,” “business purpose,” “third party,” "share" and “sell” have the meanings ascribed to them respectively in the CCPA. References to “we”, “us”, and “our” in this Notice mean Jarrow Formulas, Inc.)
- Access Request – You have the right to request, up to two times every 12 months, that we disclose to you the categories of personal information collected about you, the business or commercial purpose for collecting or selling your personal information, the categories of sources from which the personal information is collected, the categories of such personal information sold or disclosed in the last 12 months, the categories of third parties with whom we share the personal information, and the specific pieces of personal information collected about you over the past 12 months. You have the right to request a portable copy of your Personal Information. You also have the right to request and receive certain information about our disclosure of your personal information to third parties for direct marketing purposes. We do not sell and will not sell your personal information. Please note that we may share personal information in connection with a transaction as described in our Privacy Policy.
- Deletion Request – You can request that we delete your personal information that we maintain about you, subject to certain exceptions.
- Sale/Sharing Opt-Out Request – You can request to opt-out of the sale of your personal information to a third party and the sharing of your personal information for cross-context behavioral advertising. Our Site is designed for consumers at least 18 years of age, and, as such, we do not sell or share the personal information of minor consumers. Note that some web browsers allow you to set a global “Do Not Track” flag that is visible to websites. We will treat these flags as valid opt-out requests under California law. However, note that these signals are associated with a specific device and will not transfer when you switch web browsers, such as from a laptop to a mobile device. Additionally, we do not keep records that match users to their web browsers or IP addresses. Therefore, you will need to submit a written request to exercise these rights as they relate to your information in our customer records. We share personal information with third party vendors to provide more relevant, personalized ads to consumers. We also use third party data analytics providers, such as Google, whose collection of information may be considered a “sale” of information under the CCPA. To opt-out of sharing and selling of your personal information, visit our Do Not Sell of Share My Personal Information page. Please note that online opt-outs are device and browser-specific. You may still see personalized ads from us while using a different device or browser, unless you also opt-out using that device or browser. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales or sharing. However, you may change your mind and opt back in to personal information sales and sharing at any time.Â
- Correction Request – You can request that we correct inaccurate personal information. We will use commercially reasonable efforts to make such edits as directed pursuant to the CCPA.
- Limitation Request – You can request that we limit our use of sensitive personal information to only that use which is necessary to perform the services or provide the products reasonably expected or to fulfill the reason that we collected such information and/or other permissible business purpose. Please note that we do not use or disclose your sensitive personal information for purposes other than to provide you with products and/or services. However, note that this information may be used, or disclosed to a service provider or contractor pursuant to a written agreement in order to provide such products and/or services. If you choose to limit such use, you can opt-in to such use again by contacting us via email. Note that this right does not apply to sensitive personal information that is collected or processed without the purpose of inferring characteristics about you.
None of the foregoing prohibits us from charging an individual a different price or rate, or from providing a different level or quality of goods or services to you, if that difference is reasonably related to the value provided to us by your personal information.
We will not discriminate or retaliate against you for exercising any of your CCPA rights.
To exercise your privacy rights, you may email us at CAprivacy@vytalogy.com or call us at 1-818-867-4440. You may submit CCPA requests yourself or you may have your authorized representative submit one or more requests on your behalf.
Please note: if you would like to opt-out of cookie-based tracking for advertising purposes, you will need to separately adjust your browser settings and set your preferences as described in our Privacy Policy.
We will take reasonable steps to verify your identity (or the identify and authority of your authorized representative) prior to responding to your requests under CCPA. Upon receiving an Access, Deletion, Correction or Limitation request, we will confirm receipt within 10 days and provide you with information about how we will verify and process the request. In order to verify your request, we may require you (or your authorized representative) to provide your first and last name, address and email address.
In response to a verified Access Request, we will disclose and deliver the required information to you free of charge within 45 days of receiving a verifiable consumer request. We may extend this time period once by an additional 45 days when reasonably necessary. We will provide notice of the extension within the first 45-day period. We will respond to all other requests within this same time period.
