Jarrow Formulas Joins Coalition To Express Concern About Proposed Revisions To Prop65
LOS ANGELES - November 13, 2015 - Jarrow Formulas®, a formulator and supplier of superior nutritional supplements, has joined a coalition headed by the California Chamber of Commerce to express concerns about California Office of Environmental Health Hazard Assessments (OEHHAs) proposed revisions of the Maximum Allowable Dose Levels (MADLs)of lead designated by Proposition 65.
Organizations taking part in the coalition are the American Herbal Products Association, Agricultural Council of California, California Grocers Association, Pacific Water Quality Association, and the Council for Responsible Nutrition as well as 80 additional organizations with the intention of encouraging OEHHA to reevaluate their proposal.
OEHHA has drafted a pre-regulatory proposal aimed at further defining the safe harbor MADLs of lead. The proposal is highly technical in nature and looks to define not only safe harbor MADLs of lead as daily exposure cap limits but all other safe harbor MADLs as single-day limits as well. The proposal by OEHHA would place range limits on lead of 0.2 micrograms (?g) per day for daily exposures up to a maximum of 8 micrograms in one day of every 116 days or more. Current Prop65 MADLs for lead are set at 0.5?g per daily serving.
An ongoing source of contention is the application of the regulations and the manner in which products are challenged. Initially created to provide consumer safety, Prop65 has given rise to numerous lawsuits that do not improve consumer safety but rather have a negative impact on costs due to settlements that do not provide additional resources for better policing of products that may in fact be harmful. Approximately 70% of settlement payments from 2014 went to attorneys fees and costs according to Proposition 65 Settlement Executive Summary 2014.
"These new standards would create a serious disruption of interstate commerce and even international trade," argues Jarrow Rogovin. "The unethical behavior exhibited by trial attorneys will only be further encouraged should the OEHHA proposal go through."
Californias Proposition 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, was originally designed to set forth safe levels of exposure to toxins, including heavy metals, that are known by the state of California to cause birth defects or other reproductive harm. This list has now grown to over 800 chemicals. If one of these chemicals is present within a product above the proposition 65 standard, businesses are required to provide a warning on the label. The level of safe exposure is determined first by finding the no observable effect level, and then dividing that level of exposure by 1,000. This extra step of dividing by 1,000 creates an abnormally low threshold.
Since the passing of Prop65, Jarrow Formulas has maintained the highest level of transparency by labeling all products that do not meet the strict standards set forth by the proposition. While all Jarrow Formulas products conform to federal standards, compliance with Prop65 is challenging when it is applied to products that contain ingredients with naturally occurring levels above what is accepted under Prop65.
